1- GENERAL DEFINITIONS

This website is operated by the owner of an individual children’s equipment rental company, which appears on this website under the name TEDDYRENTAL. By visiting this site or renting it, you agree to the following terms and conditions.

In this agreement “You” are the client and “We” are Teddyrental  Lenka Kuželová Sikorová, IČ 17402701, K Višňovce 201, 25265 Holubice

2 – PRESENTATION OF ACTIVITIES :

Teddyrental rents children’s equipment in the Prague area. The rental period is from 1 day to a maximum of 60 days. The rental service is subject to availability of material and applies to all material that can be rented through our website.  Photographs and text on the site are not contractual and there may be minor colour variations, which do not affect its quality or the rental agreement.

3- ORDER

The order must be made through the Teddyrental form on our website or by email. We will confirm availability within 24 hours and send you an email with the final price and a link for payment. Once you proceed to payment, you will receive an email from us confirming your booking. The order is considered confirmed once we receive your payment. This creates a legally binding contract between us.

The rental period starts on the day we make the equipment available to you. The entire rental period will be charged regardless of events that reduce the number of days of use of the equipment, even in the event of early return.

You have the option to extend the initial rental period. In this case, you will be charged for the new total period. The balance of the difference must be paid no later than when the equipment is returned. Extensions will only be accepted if the relevant equipment is available, otherwise you must return the equipment as stipulated in the original contract.

4- DELIVERY OF MATERIAL

We deliver to all addresses within the territory of Prague. We -or someone appointed by us- will deliver to the address you have given us in the Teddyrental form. We reserve the right not to deliver outside of Prague and to charge additional delivery costs if we choose to deliver outside of this area.

In the Prague area we will deliver between 9:00am and 7:00pm, to the address and time agreed in the Teddyrental form or email. The time you have requested in the Teddyrental form is not contractual and we reserve the right to change it in case of necessity or force majeure. In the event of delivery outside of our service hours (9am to 7pm), we reserve the right to charge additional costs.

Delivery and collection costs (including VAT):
– A cash deposit of 100 euros is required upon delivery of the goods. After handing over the goods, according to the terms and conditions, the amount will be refunded. – 15 Euros for any order to be delivered or picked up in Prague between 9am and 7pm. – +20 euros for delivery or collection on Sundays, public holidays and/or outside our delivery hours (9am-7pm). This is the rate above the delivery amount. The amounts are therefore added together. (35 Euros)

In the event that you – or a person nominated by you – are not at the agreed address and time, we will try to contact you by email or telephone to arrange a new delivery or collection date: in this case we reserve the right to deliver or collect the parcel at a later date and charge you additional delivery costs. We also reserve the right to rent to another client equipment that could not be delivered at the agreed date or time.

In the event of events beyond our control and in cases of force majeure (strikes, storms, delays in returning previous rentals, etc.), we may be forced to delay or cancel delivery; in such cases, we cannot be held responsible for the direct or indirect consequences thereof.

The material will be delivered clean and in good condition, with proper packaging if necessary. The material must be inspected on receipt. If the material is not in good condition or does not match the equipment ordered, you should inform us immediately and we will replace it as soon as possible. Please note that the photographs on the website are for illustration purposes only. The goods will be
delivered to you in the same category, but may not be the brand shown on the website.

5-USE OF MATERIAL

All rented equipment remains the property of Teddyrental at all times. The rented equipment is for private use, not for commercial use, unless agreed in advance with Teddyrental. It is not permitted to lend the rented items to other persons.

You must ensure the safety of the equipment and arrange for its safekeeping.

You must use the equipment in a safe and sensible manner and in accordance with the purpose for which it was supplied and the manufacturer's instructions.

As with any other activity, adult supervision is required when children use any borrowed item.

Installation of the items provided will be done by you. Most of our items are provided fully or partially assembled.

6-CONDITION OF EQUIPMENT ON RETURN

At the end of the rental period, you must return the material in the same condition as you received it and only minor wear and tear caused by normal use should be accepted.

When returning hired equipment, if the product or any part of it is damaged, broken, lost or stolen, making it temporarily or permanently unusable for the new location, you will be charged the market value of the product.

The equipment must be returned with the same or similar packaging system.

All items must be returned clean, if an item is returned dirtier than expected for proper use, additional amounts will be charged.

If equipment is returned to us late and within 24 hours of the end of the rental period, we reserve the right to charge additional amounts. If the material is not returned to us even 24 hours after the end of the rental period, you will be charged the market value of the product.

We will report any damage and/or non-functionality of the products to you within 5 working days of the return of the rental equipment and inform you of the costs that will be charged.

7- CANCELLATION

If you wish to cancel your contract with us, you must notify us in writing, by email to teddyrental@info.cz..

If you cancel your order or part of it less than 48 hours before the scheduled start of the rental, we will only refund the delivery charges.

The full rental period will be charged regardless of events that reduce the number of days of use of the equipment, even in the event of early return.

Teddyrental reserves the right to refuse a rental or cancel an order in cases such as: stock unavailability, non-payment of order, out of area delivery, etc. Once we notify you that we are cancelling your contract, any amount paid will be fully refunded to your account within 5 working days of cancellation between us.

8. TEDDYRENTAL'S LIABILITY

If the equipment supplied by us does not match what you ordered or is damaged or faulty, we will not be liable to you unless you notify us immediately upon receipt. You must inspect the material on receipt. If the material is not in good condition or does not match the equipment you ordered, you should inform us immediately and you can choose whether we will give you a full refund or ask for a replacement. In this case we will endeavour to replace the equipment as soon as possible. However, it should be remembered that the photographs of the goods shown on the Teddyrental website are for illustrative purposes only. Goods will be loaned in the same category, they may not be the product shown.

Teddyrental will not be liable for any accidents, damage or injury that may occur as a result of improper use of the items provided.

We will not be liable to you for any indirect or consequential loss, damage or expense and we are not obliged to pay you any money as compensation other than a refund of the amount you paid for the equipment in question.
The contract between us shall be governed by and construed in accordance with Czech law and the Czech courts shall have jurisdiction to settle any disputes between us.

9. PRIVACY POLICY

This Privacy Policy describes how your personal information is collected, used and shared when you visit or make a purchase from www.teddyrental.cz (the "Site").

PERSONAL INFORMATION WE COLLECT

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and certain cookies that are installed on your device. In addition, when you browse the Site, we collect information about the individual web pages or products you view, what web pages or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically collected information as "Device Information."

We collect Device Information using the following technologies:
– “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

– “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. – “Web beacons,” “tags,” and “pixels” are electronic files used to record information about how you browse the Site.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, passeport or ID number, payment information (including credit card numbers or informations of your bank account), email address, and phone number. We refer to this information as “Order Information.”

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
Communicate with you;
Screen our orders for potential risk or fraud; and
When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information, as described above (for example our accountant). Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through email (teddyrental@info.cz). Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION
When you place an order through the Site, we will maintain your Order  Information for our records unless and until you ask us to delete this information.

CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
